Extradition is a procedure that often involves practicing lawyers and ordinary citizens who find themselves in difficult situations. The essence of this concept is as follows: when a citizen of one country is pursued in their homeland for certain reasons, they seek asylum in another country. At the request of the authorities of their home country or at the initiative of the country where they are currently located, the accused can be handed over to their homeland—this is what is known as extradition.

It is important to know that this procedure is only possible if there is a relevant agreement between the two states. Additionally, there are many nuances, which we will discuss below.
КAs mentioned earlier, this procedure is possible if there is a specific agreement between the states. However, it is also possible for a criminal to be sent back to their home country without such a document. In this case, the "principle of reciprocity" comes into play, and the country hosting the offender is obliged to provide a significant benefit to the requesting country.

This principle is voluntary, and whether to provide a benefit to the requesting country is at the discretion of the state.
Extradition to France will be carried out if a French citizen has committed an unlawful act in another country, provided that the receiving country guarantees that their life and health are not at risk. Furthermore, there must be strong grounds and sufficient evidence of the accused's guilt for extradition to occur.

So, in which cases is extradition inevitable?
In some situations, extradition becomes impossible. For example, extradition to Russia will not occur if the pursued Russian citizen has requested political asylum in France and has been granted refugee status.
Extradition is not applied if the statute of limitations for the crime has expired.
If the charges against the accused are of a private nature, they will also not be extradited to their home country.
What Can Help Avoid Extradition?

The extradition process occurs in several stages. First, a relevant request is submitted, which the country holding the accused reviews for approximately 40 days (from the moment of their detention). The individual under suspicion is then handed over to the local prosecution, while the requesting country verifies the legality of the extradition.

The decision on extradition is made by the Prosecutor General's Office.

If extradition is approved, a ruling is issued, and the accused is notified. The accused has 10 days to appeal the extradition decision.
Extradition Procedure
Russian legislation has its own specific features regarding extradition. For example, if Russian citizens commit an offense on French territory, extradition to France will not occur; however, they will be prosecuted to the fullest extent under Russian law.
Returning "its own" criminals to Russia is also challenging, as Western courts do not have much trust in the local justice system.
